Two Queensland brothers attacked a family on the Gold Coast after a Boxing Day dispute over a parked car escalated, a court has heard.

Two Gold Coast brothers allegedly attacked a family with a shotgun and metal pole after a Boxing Day spat over a pink car parked in front of a rural property escalated, a court has heard.

Francesco Surace, 42, and his brother Giuseppe Surace, 41, are accused of attempting to murder Isaac Wensley and Raymond Wensley at a five-hectare property in Pimpama in 2016.

The dispute began when an agitated Francesco Surace walked into Raymond Wensley’s home wearing just shorts and told Mr Wensley’s wife, “I am here to claim my land rights, this is my house.”

Crown prosecutor David Meredith says after Surace told the Wensleys they were trespassing he assaulted Raymond Wensley with an array of martial arts kicks.

“He continued to act strangely and say strange things while Mr Wesley tried to get him to leave. At one stage Francesco says to Mr Wensley ‘I am going to kill you, you f***ing dog’,” Mr Meredith told the Brisbane Supreme Court on Tuesday.

Surace was arrested with his dog, which had a pink collar, nearby soon after before being bailed on the condition he didn’t return to the Wensley’s property.

But he didn’t stay away, Mr Meredith says.

The Surace brothers made a series of visits to the Wensley property during Boxing Day to recover Francesco’s pink Holden Barina.

Triple-zero calls to police recorded the escalating confrontations between the men.

During one attempt, Raymond Wensley used a piece of wood to hit the car Francesco was being dropped off in by Giuseppe Surace as they arrived to recover the Barina.

“He hit the driver’s side window and breaks the glass. The vehicle then goes up the street to the end turns around and comes back, and drives close beside (Raymond Wensley) again before leaving,” Mr Meredith said.

Mr Meredith says an “irate” Raymond Wensley then used a tractor to roll the pink Barina on its roof.

The day culminated when Francesco Surace returned to Raymond’s Wensley’s home on foot wearing “martial arts shin guards” and carrying a backpack.

“He takes out a sawn-off shotgun and points it directly at Raymond and or Issac Wensley,” Mr Meredith said.

At the same time, Mr Meredith says, his brother Giuseppe Surace arrives in a red Ford, which he parks between the two parties, before jumping out with a metal bar and smashing Raymond Wensley over the head.

“A metal bar is found in the red Ford … Subsequently, it has skin and hair on it, which matches the DNA of Raymond Wensley,” Mr Meredith said.

Francesco Surace then shot Isaac Wensley in the face as he swung a baseball bat at Giuseppe.

“There cannot have been any other intent when you shoot a shotgun from that range in that direction other than to have the intent to kill,” Mr Meredith said.

The Surace brothers pleaded not guilty to the attempted murder charges. The trial is set down for seven days.
